In these Terms and Conditions, references to “we,” “us,” and “Arabica” refer to Arabica Food Limited, a company registered in England and Wales under registration number 11493707. Our registered office is located at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

 

1.     ONLINE SHOPPING

We take all reasonable care to ensure that product details, prices, images, and descriptions on our website are accurate at the time they are added to our system. We make every effort to display the appearance, colours, textures, and finishes of our products as accurately as possible. However, the way these appear may vary depending on your monitor and device settings, so we cannot guarantee that the images shown are a perfect representation of the actual product.

We cannot be held liable if the Arabica website is unavailable at any time or for any period. Occasionally, we may need to restrict access to some or all parts of the website.

 

2.     AGE RESTRICTIONS

In accordance with the law, we cannot sell alcohol to anyone under the age of 18. Proof of ID may be required when purchasing alcohol. We will not deliver alcohol to anyone who is, or appears to be, under 18.

By placing an order for alcohol, you confirm that you are of legal age and that the information provided is truthful and accurate.

Under the Licensing Act 1964, it is an offence for a person under 18 to purchase alcohol or for an adult to buy alcohol on behalf of someone under 18. A conviction for this offence may result in a fine of up to £1,000.

 

3.     ORDER PROCESS

All orders placed on this website are subject to acceptance in accordance with these Terms and Conditions.

Your order may not be accepted for one or more of the following reasons (this list is not exhaustive):

  • The product you ordered is out of stock.
  • We were unable to obtain authorisation for your payment.
  • A pricing or product description error was identified.
  • You do not meet the eligibility criteria to place an order, as outlined in Clause 2 of these Terms and Conditions.
  • There was a system or procurement failure.

When you place an order on our website, we will send you an order acknowledgement email detailing the products you have ordered. Please note that this email is not an order confirmation or acceptance from Arabica.

Your order is only considered accepted and confirmed once it has been dispatched. At that point, we will send you a dispatch confirmation email, completing the contract between you and Arabica.

A gift message facility is available for personal, non-commercial use. We do not accept responsibility for the content of messages you send to third parties. By using this feature, you agree that your message will not contain any content that is defamatory, abusive, obscene, racist, offensive, harassing, threatening, or otherwise inappropriate. Additionally, you must not impersonate any person, including but not limited to our employees or customers.

 

4.     DELIVERY

We deliver within the UK mainland (excluding Jersey, the Scottish Highlands & Islands) via our trusted partner DPD.

We are not liable for delayed deliveries caused by third parties or unforeseen circumstances such as fire, flood, or mechanical breakdown. If a parcel is small enough to fit through a letterbox, it may be delivered by Royal Mail and will not require a signature.

We strive to deliver orders within the estimated timescales. However, delays may sometimes occur due to unforeseen events beyond our control, such as extreme weather, flooding, or fire. Arabica is not liable for delays or failure to deliver within the estimated timeframe.

The risk of loss or damage to your order transfers to you once the products have been delivered.

Any claims for breakages or shortages must be reported within 24 hours of receiving your order.

 

5.     AMMENDMANTS & CANCELLATIONS

We’re happy to make amendments or cancellations up to 4 days before your nominated delivery date. After this point, production of your order will have begun, and we will be unable to make any further changes or cancellations.

To request an amendment or cancellation, please email shop@arabicalondon.com with your order number and details of the changes you’d like to make.

 

6.     RETURNS & REFUNDS POLICY

Due to health and safety regulations, we are unable to accept returns of perishable goods once they have been delivered. If you experience any issues with your order, please contact our customer service team, and we will be happy to assist you.

Please note that gift cards are also non-refundable.

None of the above refund terms affect your statutory rights when goods are faulty or incorrectly supplied nor does it affect your rights under the Consumer Protection (Distance Selling) Regulations act 2000.

 

7.     PAYMENT METHODS

We only accept payment for orders in pound (£) sterling.

We accept payment by American Express, Apple Pay, Google Pay, Maestro, MasterCard, Visa, and Visa Debit accounts.

If you choose to pay using a payment card linked to a foreign currency-denominated account, the amount will still be charged in pounds (£) sterling, at the conversion rate applied by the relevant payment scheme at the time of processing your order.

By making an offer to purchase a product, you specifically authorise us to transmit or obtain information about you from third parties, including but not limited to your debit or credit card number or credit reports. This may be done to authenticate your identity, validate your credit card, obtain an initial credit card authorisation, and authorise individual purchase transactions. 

 

8.     PRICING POLICY

All prices are inclusive of VAT (where applicable) at the appropriate rate for the country of receipt within the EU and are correct at the time of entry into the system. Prices may change, and offers may be withdrawn at any time.

While we strive to ensure that all prices displayed on our website are accurate, errors may occasionally occur. If we discover an error in the price of an item you have ordered, we will contact you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we will treat your order for the incorrectly priced item as cancelled.

From time to time, we may offer additional discounts for purchases made online at www.arabicalondon.com that may not apply at our other trading locations, and vice versa. Additionally, items sold as sets on our website may not be available as sets at other outlets, where individual pricing may apply.

Any Discount offer is non-transferable and cannot be used in conjunction with any other offer. There is no cash alternative. You must be 18 years or older to qualify.

 

9.     COPYRIGHT POLICY

Copyright and other intellectual property rights in any communications, ideas, or materials submitted or offered to us by you through or on this website—unless specifically requested by us—shall become our property. You agree that any submissions you make to this website must not infringe on the rights of any third party. Additionally, you agree that no submissions will contain libellous, unlawful, abusive, or obscene material or constitute an invasion of privacy. You are and shall remain solely responsible for the content of any submissions you make to the website.

You acknowledge and agree that the material and content on this website are provided for personal, non-commercial use only. You may download material solely for the purpose of using this website.

Accordingly, we advise that you do not use the Arabica website to (and agree not to assist or enable any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit, or create derivative works from such material or content.

10.     CONTENT/ACTIVITY PROHIBITED

Please choose carefully the information you post on the Arabica website and share with other users. You must not misuse the Arabica website. Specifically, you must not:

  • Upload viruses, trojans, worms, logic bombs, or other malicious code.
  • Corrupt data.
  • Cause annoyance to other users.

Arabica Community Areas are subject to the following Community Area Rules:

  • We advise you not to reveal personal information (about yourself or others) that could identify you, including but not limited to phone numbers, home or business addresses, delivery addresses, or email addresses.
  • By submitting any material to us, you automatically grant Arabica a royalty-free, perpetual, exclusive right and licence to use, modify, edit, adapt, publish, re-use, translate, distribute, perform, and display such material (in whole or part) worldwide and/or incorporate it into other works in any form, media, or technology now known or later developed.
  • You acknowledge that we are not obligated to publish any material submitted by you.
  • By submitting any material, you agree to use the Arabica website and Community Areas in accordance with these Community Area Rules and our website Terms and Conditions.
  • If you fail to abide by these Community Area Rules, you may receive an email notification explaining why your contribution was refused or edited. This email may also warn you that continued rule violations could result in further action, including:
    • Content moderation before publication.
    • Temporary or permanent suspension of your ability to participate on the Arabica website.
  • We reserve the right to edit or delete any contribution, or take action against any user account, at any time, for any reason.
  • If you do not wish to grant Arabica the permissions outlined above, please do not submit or share your content in the Community Areas.

Arabica shall not be liable for any direct, special, incidental, indirect, or consequential damages, including loss of profit or loss of opportunity, resulting from the use of, or inability to use, the material on this website or from the conduct of other users, even if Arabica has been advised of the possibility of such damages.

The Arabica website may contain links to external websites that are not operated by us. When you activate any of these links, you will leave the Arabica website. We have no control over, and accept no responsibility or liability for, the content of any external website that is not under our control.

You agree to indemnify us, along with our agents, officers, directors, and employees, immediately on demand, against all claims, liabilities, damages, costs, and expenses (including legal fees) arising from any breach of these Terms and Conditions by you.

We reserve the right to immediately terminate your use of the website if we determine that you have breached these Terms and Conditions.

 

12.     COMMENTS AND COMPLAINT PROCEDURE

If you’re unhappy with any aspect of your online shop order, please contact our customer service team within 48 hours. You can reach us via email at shop@arabicalondon.com or by phone at 020 7708 5577 (Monday – Friday, 9 am – 5 pm).

To help us resolve the issue efficiently, please provide photos and/or temperature readings (where applicable) to document any damage or concerns. We aim to acknowledge your complaint within one working day and provide a proposed resolution within five working days.

 

13.     PERSONAL INFORMATION

Your submission of personal information through the store is governed by our privacy Policy.

 

14.     LINKING TO WEBSITE

You must not establish a link to this website to suggest any form of association, approval or endorsement on our part where none exists or establish a link from any website that is not owned by you.

Our website must not be framed on any other site, and you may not create a link to any part of this website other than the home page.

 

15.     JURISDICTION

The website is controlled and operated in the UK. Any terms and conditions concerning the usage of this website will be governed by the laws of England and any dispute concerning use of this website will be determined exclusively by the English Courts.

We may update or amend these Terms and Conditions at any time. If any provision within these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue to be in full force and effect.

If you breach these Terms and Conditions, and we do not take immediate action, we still reserve the right to enforce our rights and remedies in future instances of non-compliance.

Arabica reserves the right to amend, remove, or modify the Services and/or any page of this website at any time, without prior notice.

 

17.     ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Arabica. Any waiver of any provision of the Terms and Conditions will only be effective if in writing and signed by a Director of Arabica Food Limited.
